Peruvian Digital Nomad Visa

On November 14, 2023, a modification of the Foreigner Law, Decreto Legislativo 1582, was published, introducing a resident visa for digital nomads, remote workers, and freelancers in Peru for the first time.

This new Digital Nomad Visa is intended to allow foreigners who work independently or are employed by a company outside Peru, using digital communication technologies and systems, to apply for and obtain a resident visa in Peru. It does not allow foreigners to work for a Peruvian company or generate income in Peru. All income must be earned abroad while residing in the country.

Shortly after the publication of the new Foreigner Law, excitement surrounding the Digital Nomad Visa was high. However, this enthusiasm soon gave way to disappointment, as the visa could only become available once included in the Migraciones administrative regulations, known as TUPA. For all Migraciones procedures, the TUPA defines the application process, required documents, and specific eligibility criteria.

When a new Migraciones TUPA was published in August 2024 - nine months after the introduction of the Digital Nomad Visa - hopes were high that it would finally be included and made available. However, the 2024 TUPA did not mention the Digital Nomad Visa at all. In September 2025, another updated TUPA was published, once again without any reference to the Digital Nomad Visa. As a result, more than two years after its introduction in the Foreigner Law, the Digital Nomad Visa is still not available in Peru.

Hard to understand given the time that has passed, but it appears that the Peruvian government is still working on defining the regulations, required documents, and eligibility criteria for the Digital Nomad Visa.

As of January 2026, there has been no official news. For now, all that remains is to wait and hope for further information.
