How to apply for the Amnistia de Multa (Ley 31732)

On May 2, 2023, the Peruvian government put a law (Ley 31732) into effect granting foreigners, who violated article 56 of the Foreigner Law (Decreto Legislativo 1350) amnesty. So, they don't have to pay the in some cases excessive fines for infringements.

Unfortunately, the amnesty option expired at the end of October 2023.

Who benefits from the amnesty?

Benefitting from this amnesty are mainly foreigners who haven't extended their residence visa on time which was fined with 1 UIT (in 2023 that's S/ 49.50) per day being late, but as well those who haven't updated their information in the Migraciones database within 30 days, haven't renewed their carné before expiration and have carried out activities not corresponding to their immigration status.

The amnesty as well applies to foreigners who have already agreed on an installment plan with Migraciones or are paying installments. However, it is unclear at this moment if those who have already paid their fine completely can get a refund.

Please be aware that the amnesty does not apply to tourists in Peru, who have overstayed.

To be granted amnesty, you must apply for it. And the amnesty only exempts you from paying the fine. After you received the resolution granting you amnesty, you immediately must, for example, apply for the extension of your residence visa, update your information or apply for a new carné.

According to the law 31732, the amnesty is only granted for the next 6 months. So, you only have until the end of October 2023 to apply for it.

 

How to apply for the amnesty?

Applying for the amnesty is a simple, quick, and straightforward process.

Open the Migraciones Agencia Digital and click on Entrar.

On the next page, select "Extranjero". Then choose in the drop-down menu Carné de extranjería and enter your carné number. Click on Validar and complete the other fields (birth date, date your carné was issued, nationality, last time you entered Peru and the Captcha).

You are now on the main page of the Agencia Digital. If your residence visa is expired, you already see in the top menu Venc. Residencia and the date your residence visa expired.

Anyway, in the left menu select the point Acogimiento de amnistia.

A window pops up informing you that the amnesty does not fix your immigration status and explaining that you must apply for the corresponding process. Click on Entendido.

You now see a page on the screen with all your personal information registered in the Migraciones database. The only fields you can change here are your cell phone number and your e-mail address. Click on Siguiente.

2nd page of the amnesty application - Terminos y condiciones

Here you confirm that you possibly violated article 56 of the Foreigner Law (Decreto Legislativo 1350) and are subject to the corresponding fine. Therefore, you ask that law 31732 is applied which grants amnesty for fines for foreigners.

Accept the terms and conditions and click on Siguiente.

You are then informed that you are notified via e-mail about any administrative act and decicion regarding your application for amnesty.

Here you once more get the pop-up window informing you that the amnesty only exempts you from paying the fine and explaining that you must apply for the corresponding process to fix it. Click on Entendido.

You now get the "Acogimiento de amnistia" displayed on your screen. That's the confirmation of your successful application. Download and/or print the form, read it and keep it safe. Click on Finalizar.

 

After your application

Now, check your e-mail. Migraciones should have sent you a notification that your application for amnesty was successful. Don't miss the attachment with the official resolution. Read it and keep it safe.

That's it. You now must and can without having to pay the fine apply, for example, for the extension of your residence visa.

    On the page "Peruvian Overstay Fine" you said the fine is 0.1 UIT, but above you state that it is 1 UIT per day. Which is it?

      Hello Andrea,

      these are two different things:

      If you overstayed your stay as a tourist, you must pay the overstay fine. It's 0.1% of an UIT per day you overstayed; in 2023 this equals S/ 4.95 per overstayed day. The above explained amnesty does not apply to tourists in Peru, who have overstayed.

      If you haven't, among other things, extended your residence visa on time, the fine is 1 UIT per day you are late; in 2023 this equals S/ 49.50 per late day. The amnesty only applies to residents and ends at the end of October.

      So, if you are a tourist who overstayed, you must pay 0.1% of an UIT per day; if you are a resident and, for example, didn't extend your residence visa on time you pay 1 UIT per day.
